MINUTE of MEETING of ANGUS COUNCIL held in the Town and County Hall, Forfar on Thursday 13 May 1999 at 4.00 pm.

1. INTERIM CHAIRMAN OF MEETING
In terms of Section 3(3) of the Local Government (Scotland) Act 1973, Mr A B Watson, Chief Executive, in his capacity as Returning Officer, took the Chair and welcomed all members to this first meeting of Angus Council following the ordinary election of Councillors on Thursday 6 May 1999.

3. ELECTION OF PROVOST
Councillor Murray, seconded by Councillor William Middleton, moved that Councillor Mrs Frances E Duncan be elected the Convener of the Council, to be known as the Provost, in terms of Section 4 of the Local Government etc (Scotland) Act 1994. There being no other nominations, Councillor Mrs Duncan was declared duly elected and thereafter took the Chair.
4. ELECTION OF DEPUTE PROVOST
COUNCILLOR MURRAY, SECONDED BY COUNCILLOR WILLIAM MIDDLETON, MOVED THAT COUNCILLOR BRIAN M C MILNE BE ELECTED AS DEPUTE CONVENER OF THE COUNCIL, TO BE KNOWN AS THE DEPUTE PROVOST, IN TERMS OF SECTION 4 OF THE LOCAL GOVERNMENT ETC (SCOTLAND) ACT 1994. Councillor Speirs, seconded by Councillor Myles, moved as an amendment that Councillor George Norrie be so elected. On a vote being taken, members voted as follows:- For Councillor Milne: Provost Mrs Frances E Duncan, Councillors Ian Angus, Crowe, Kay Ellis, Frank Ellis, Gibb, Gray, Henderson, King, Leslie, McGlynn, Glennis Middleton, William Middleton, Mowatt, Murray, Roberton, Selfridge, Welsh and West (19). For Councillor Norrie: Councillors Lumgair, Mackintosh, Leslie Melville, Myles, Murphy, Nield and Speirs (7). No vote: Councillors Milne and Norrie (2). The motion was declared carried and accordingly Councillor Brian M C Milne was duly elected as Depute Provost.

(c) Appointment of Members
The Council resolved to remit to the Leaders of each Political Group to advise the Director of Law and Administration by Tuesday 18 May 1999 at 4.00 pm of the names of the members appointed to each Standing Committee in terms of Article 5(a) above. (NOTE: The membership of each Standing Committee is shown in the APPENDIX to this minute.)
(d) Education Committee
The Council resolved in terms of Standing Order 31(iii) to appoint five additional persons, not being members of the Council, to the Education Committee as follows:- (i) three persons representative of Church interests appointed in terms of Section 124 of the Local Government (Scotland) Act 1973, namely:-
Rev C Robertson (nominated by the Church of Scotland) Rev M Cassidy (nominated by the Roman Catholic Church) A third person to be appointed in terms of the Scheme adopted by the Council on 16 August 1995.
(ii) two teachers employed in educational establishments under the management of the Council, to be nominated by the teacher representatives on the Joint Consultative Committee (Teachers).
6. APPOINTMENTS TO OUTSIDE BODIES, ETC
(a) Representation on Joint Boards, Joint Committees and Outside Bodies
There was submitted Report No 482/99 by the Director of Law and Administration advising the Council of the appointments which fell to be made to various Joint Boards, Joint Committees and Outside Bodies.
The Council resolved as follows:- (i) to defer consideration of the appointments, except those referred to in (ii) below, until the next ordinary meeting; and (ii) to appoint the following members as its representative(s):-

(b) COSLA - Election of Office Bearers
There was submitted letter dated 29 April 1999 from the Chief Executive of COSLA drawing to the Councils attention the provisions of the Constitution of the Convention relevant to the election of the President and two Vice-Presidents. The Council resolved to delegate to the Convener and Vice-Convener of the Policy and Resources Committee to consider the position regarding nominations for the posts of President and Vice-President of the Convention by the date specified in COSLAs Constitution.
(c) Angus Licensing Board
There was submitted Report No 483/99 by the Director of Law and Administration relating to the Councils obligations in terms of the Licensing (Scotland) Act 1976 to appoint, at its first meeting after the ordinary election of Councillors, members to the Licensing Board. The Board required to consist of not less than one quarter of the total number of members of the Council (subject to an overriding minimum of five).
The Council resolved as follows:-
(i) to retain the composition of the Licensing Board at 13 members,
representing each part of the Angus area;
(ii) to adopt the representational groupings contained in Appendix 1 to
the Report, subject to Wards 5 & 6; Wards 7, 8 & 14; Wards 10 & 12; and Wards
11 & 13 being grouped together;
(iii) to appoint members to represent these Wards on the Board as
follows:-

(d) Charitable Trusts
There was submitted Report No 484/99 by the Director of Law and Administration informing members of the existence of various Charitable Trusts in Angus and seeking the appointment of trustees to administer their funds. The Appendix to the Report listed the Trusts by each Burgh, with those covering landward areas shown separately.
The Council resolved as follows:-
(i) to appoint as Trustees for the Trusts in Arbroath, Brechin,
Carnoustie, Forfar, Kirriemuir and Montrose, all the Councillors representing any part of
the respective former burghal areas, and where appropriate any ex officio Trustees,
all as shown in the Appendix to the Report; and
(ii) to appoint as Trustees for the Trusts affecting landward
communities, the local member, together with the Provost and Depute Provost ex officiis,
again as shown in the Appendix to the Report.
7. APPOINTMENT OF EX OFFICIO JUSTICES OF THE PEACE
There was submitted Report No 485/99 by the Director of Law and Administration relating to the appointment of ex officio Justices of the Peace by Angus Council. The Report indicated that, in terms of Section 11(2) of the District Court (Scotland) Act 1975, a Council could nominate up to one quarter of its members to serve as ex officio Justices for the Commission area within which the Council lay.
The Council resolved to appoint the following seven members as ex officio Justices of the Peace to the Commission of Angus:

8. TIMETABLE OF MEETINGS
The Council agreed to note and adopt the timetable of meetings for the period until March 2000, previously approved by the Council and submitted to the meeting.
