ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 2 May 1996 at 7.30 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, Provost Mrs FRANCES E DUNCAN, Councillors FRANK ELLIS, ALEX KING, GEORGE LAMONT, WILLIAM MIDDLETON, BRIAN MILNE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

1. BUILDING WARRANTS
There was submitted and noted Report No 304/96 by the Director of Planning, Transport and Economic Development detailing Building Warrants recently issued.
2. APPLICATION FOR RELAXATION OF BUILDING STANDARDS
There was submitted and noted Report No 306/96 by the Director of Planning, Transport and Economic Development detailing applications granted for Relaxation of Building Standards in accordance with Regulation 20 of the Building (Procedure) (Scotland) Regulations 1981.
3. PLANNING APPLICATIONS
There was submitted Report No 305/96 by the Director of Planning, Transport and Economic Development on applications for planning consent.
The Committee agreed as follows:-
Delegated Approvals
(i) To note consents issued by the Director of Planning, Transport and Economic Development as in List A of the Report.
Recommended Refusals
(ii) To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.
Recommended Approvals
(iii) To grant consent subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, additional conditions approved by the Committee in respect of the applications detailed in List C of the Report and appended to this minute.
Debated Application
(C) (iv) The Committee considered Application No D21870 by Mr and Mrs C Nicoll for planning consent for the provision of a two bedroom roof extension at 34 Gagiebank, Wellbank as detailed in Report No 305/96 by the Director of Planning, Transport and Economic Development who recommended refusal for the reasons stated in the Report.
Mr Nicoll was heard in support of the application, following which the local member, Councillor Ellis, was also heard. It was noted that the Planning Officer of the former City of Dundee District Council had on 12 March 1996 advised the applicants' architect that he would support the application.
Following detailed discussion, COUNCILLOR ELLIS SECONDED BY COUNCILLOR SHAND MOVED THAT THE APPLICATION BE APPROVED. Councillor Milne seconded by Councillor King moved as an amendment that the application be refused.
On a vote being taken, seven members voted for the motion (Provost Duncan, Councillors Ellis, G Lamont, W Middleton, Shand, West and Young) and five voted for the amendment (Councillors Ritchie, Mowatt, Doig, King and Milne). The motion was declared carried and became the finding of the meeting.
4. PLANNING APPEAL DECISION - MARYKIRK ROAD, HILLSIDE, MONTROSE
There was submitted Report No 288/96 by the Director of Planning, Transport and Economic Development on the findings of the Reporter appointed by the Secretary of State to determine an appeal against the refusal by Angus District Council to grant consent for a housing development at Marykirk Road, Hillside.
The Report noted that the Secretary of State had upheld the appeal and awarded the applicant 75% of his costs of the appeal. The Convener, who was also the local member, expressed dismay at the Scottish Offices decision and highlighted the problems which might occur in the village.
The Committee noted the position.
5. PLANNING APPEAL DECISION - 18 HIGH STREET, MONTROSE
There was submitted Report No 287/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against refusal by Angus District Council to grant consent for an illuminated fascia sign at 18 High Street, Montrose.
The Committee noted that the Secretary of State had dismissed the appeal.
6. IMPENDING APPEAL - WHITEFIELD, DRUMMIETERMONT FARM, LETHAM
There was submitted Report No 302/96 by the Director of Planning, Transport and Economic Development on an impending appeal against conditional planning permission granted by Angus District Council for the erection of a dwellinghouse at Whitefield, Drummietermont Farm, Letham, subject to the house being occupied by an agricultural or forestry worker.
After noting the implications for the Council should the appeal be upheld, it was agreed that the appeal be not contested.
7. CONSERVATION GRANT - BELLAS COTTAGE, LOGIE PERT
There was submitted Report No 277/96 by the Director of Planning, Transport and Economic Development on an application for a grant for the replacement of two windows and the installation of one window at Bellas Cottage, Logie Pert.
The Committee approved a conservation grant of £821.93, subject to the six conditions set out in the Report.
