ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 24 October 1996 at 6.40 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, FRANK ELLIS, ALEX KING, WILLIAM MIDDLETON, ALEXANDER SHAND, SANDY WEST and THOMAS I N YOUNG.
Apologies: Apologies for absence were intimated on behalf of Councillors WILLIAM DOIG, Mrs RENATE LAMONT, WALLIE LEASK, BRIAN MILNE and STEWART MOWATT.

1. BUILDING WARRANTS
It was reported and noted that between 16 September and 11 October 1996, 108 Building Warrants had been approved and six warrants amended with a total value of work amounting to £1,582,110.
2. TOURISM SIGNPOSTING POLICY
There was submitted Report No 859/96 by the Director of Roads and Director of Planning, Transport and Economic Development outlining a tourism signing policy which had been prepared in conjunction with the Angus and City of Dundee Tourist Board, Scottish Enterprise Tayside and the Scottish Tourist Board in light of a revised Scottish Office circular on tourism signposting.
Having noted that the Report had been approved by the Roads and Planning and Transport Policy Committees on 17 October, the Committee agreed, for its interest, that the policy be approved as the basis for determining applications for signs to tourist attractions and facilities.
3. SIGNPOSTING POLICY - PLANNING IMPLICATIONS
With reference to the foregoing item, there was submitted Report No 860/96 by the Director of Planning, Transport and Economic Development outlining the subsequent planning implications and considerations of adopting the new tourism signposting policy.
The Committee noted that the implications had been approved by the Planning and Transport Policy Committee on 17 October and agreed, in principle, to the recommendations detailed in the Report.
4. PLANNING APPLICATIONS
There was submitted Report No 911/96 by the Director of Planning, Transport and Economic Development on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.
(ii) Recommended Refusals
To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.
(iii) Recommended Approvals
To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report (subject to (iv) below) and appended to this minute.
(iv) Debated Applications
(a) The Committee considered application No 01/96/1490 and 02/96/1038 by Mr. A. Wilkie, for the conversion of Oathlaw Church to Silversmiths Workshop, Showroom, flat and development of adjoining land for car parking and landscaping as detailed in Report No 911/96 by the Director of Planning, Transport and Economic Development who recommended Conditional Approval.
Concern was expressed by members of public at the proposed use of the churchyard as the graveyard surrounding the church was still in use.
The local member, Councillor Mackintosh, was invited to address the Committee and also expressed concern at the proposed use.
COUNCILLOR MIDDLETON, SECONDED BY COUNCILLOR KING, MOVED THAT THE APPLICATION BE REFUSED.
Councillor Ritchie, seconded by Councillor West, moved as an amendment that the application be conditionally approved.
On a vote being taken, the members voted:-
For the motion:-
Councillors Ellis, King, Middleton, Shand and Young. (5)
For the amendment:-
Councillors Ritchie and West. (2)
The motion was declared carried resulting in the application being refused.
(b) The Commitee considered application No 02/96/1025 by Joe Carroll for retrospective consent for the installation of double canopy action windows at 3 Sparrowcroft, Forfar which was tabled by the Director of Planning, Transport and Economic Development.
Councillor Middleton, seconded by Councillor West, moved that the application be conditionally approved.
COUNCILLOR KING, SECONDED BY COUNCILLOR ELLIS, MOVED AS AN AMENDMENT THAT THE APPLICATION BE REFUSED.
On a vote being taken, the members voted:-
For the motion:-
Councillors Middleton and West. (2)
For the amendment:-
Councillors Ritchie, Ellis, King, Shand and Young. (5)
The amendment was declared carried and became the finding of the meeting, resulting in the application being refused.
5. ENFORCEMENT ACTION
(i) Old Quarry, Emmock Road, Balmuir Estate
There was submitted Report No 913/96 by the Director of Planning, Transport and Economic Development recommending the initiation of enforcement action in respect of the unauthorised depositing of waste materials on the site of the Old Quarry, Emmock Road, Balmuir Estate and the failure of the developer to carry out a planting scheme as indicated on the approved drawings and required by the conditions imposed on the planning permission granted on 14 October 1993.
A letter from the company was circulated and Councillor Ellis, the local member, expressed concern at the safety aspect of the embankment.
The Committee thereafter agreed that enforcement action be taken at the Directors discretion.
At this point (9.00 pm) the Committee agreed in terms of Standing Order No 20(6) to allow the meeting to proceed to the conclusion of the business.
(ii) 26 Fothringham Drive, Monifieth
There was submitted Report No 914/96 by the Director of Planning, Transport and Economic Development detailing the circumstances relative to a recommendation not to take enforcement action in respect of an aerial erected without the benefit of planning consent at 26 Fothringham Drive, Monifieth.
The Committee agreed that, as the development was acceptable on planning grounds, no enforcement action be taken.
(iii) 32A Market Street, Montrose
There was submitted Report No 876/96 by the Director of Planning, Transport and Economic Development recommending the initation of enforcement action in respect of a satellite antenna erected at 32A Market Street, Montrose.
The Report explained the history of the application and the problems which had arisen after which the Committee agreed that enforcement action should proceed.
