ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 22 May 1997 at 6.00 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, WILLIAM MIDDLETON, BRIAN MILNE and THOMAS I N YOUNG.
Apologies: Apologies for absence were intimated on behalf of IAN HUDGHTON, Mrs RENATE LAMONT, WALLIE LEASK, ALEX SHAND and SANDY WEST.

1. CIVIC TRUST COMMENDATION - ALMA WORKS, ARBROATH
HANDOVER OF AWARD CERTIFICATES
The Convener welcomed the design team of Alma Works, Arbroath and presented Civic Trust Commendation Award Certificates to them for their work at Weavers Close, Arbroath.
2. MINUTES OF PREVIOUS MEETINGS
The minutes of meetings of this Committee held on 10 April and 6 May 1997 were submitted, approved as correct records and signed by the Convener.
3. BUILDING WARRANTS
The Committee noted that in the period 21 April to 9 May 1997 a total of 75 Building Warrants had been approved and 14 warrants amended with an estimated total cost of £3,825,782.
4. PLANNING APPLICATIONS
There was submitted Report No 571/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.
(ii) Recommended Refusals
To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.
(iii) Recommended Approvals
To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development in respect of the applications detailed in List C of the Report and appended to this minute.
(iv) Debated Application
The Committee considered application No 01/97/1207 by Mercury Personal Communications for the erection of a 20.5 metre high Dynamic Concepts Mast with associated equipment and antennae for telecommunication purposes at Kirriemuir Hill as detailed in Report No 571/97 (List C) by the Director of Planning, Transport and Economic Development who recommended conditional approval.
A representative from Kirriemuir Community Council addressed the Committee and an agent for the applicant was also heard.
Councillor Mrs Ritchie, seconded by Councillor Mowatt, moved conditional approval.
COUNCILLOR KING, SECONDED BY COUNCILLOR MIDDLETON, MOVED AS AN AMENDMENT THAT THE APPLICATION BE CONDITIONALLY APPROVED SUBJECT TO A SECTION 50 AGREEMENT BEING SIGNED BY ALL INTERESTED PARTIES.
On a vote being taken, the members voted:-
For the motion:
Councillor Mrs Ritchie and Councillor Mowatt (2).
For the amendment:
Councillors Ellis, King, Middleton, Milne and Young (5).
Councillor Doig abstained from voting.
The amendment was accordingly declared carried and became the substantive motion.
Thereafter, Councillor Doig, seconded by Councillor Ellis, moved, as a further amendment, that the application be refused.
On a vote being taken, the members voted:-
For the motion:
Councillors Mrs Ritchie, Mowatt, King, Middleton, Milne and Young (6).
For the amendment:
Councillors Doig and Ellis (2).
The motion, for conditional approval with a Section 50 Agreement, was declared carried and became the finding of the meeting.
5. PLANNING APPEAL DECISIONS
(a) Old Balkello, by Auchterhouse
There was submitted Report No 574/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the Enforcement Notice served by Angus Council in relation to the unauthorised change of use of agricultural land to a caravan site at Old Balkello, by Auchterhouse.
The Committee noted that the Secretary of State had upheld the appeal.
(b) Taymouth Terrace, Carnoustie
There was submitted Report No 575/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of a signboard at Taymouth Terrace, Carnoustie.
The Committee noted that the Secretary of State had dismissed the appeal.
(c) Duncan Road, Letham
There was submitted Report No 576/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of a house at Duncan Road, Letham.
The Committee noted that the Secretary of State had dismissed the appeal.
(d) 2 Glencova Terrace, Forfar
There was submitted Report No 577/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of a garage at 2 Glenclova Terrace, Forfar.
The Committee noted that the Secretary of State had dismissed the appeal.
