ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 23 October 1997 at 6.00 pm.
Present: Councillors MRS KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, STEWART McGLYNN, WILLIAM MIDDLETON, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.
Apologies: Apologies for absence were intimated on behalf of Councillors MRS RENATE LAMONT and BRIAN MILNE.

1. BUILDING WARRANTS
The Committee noted that in the period 22 September to 10 October 1997 a total of 68 Building Warrants had been approved and 10 warrants amended with the estimated total value of the work amounting to £1,332,028.
2. PLANNING APPLICATIONS
There was submitted Report No 1119/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.
(ii) Recommended Refusals
To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute
(iii) Recommended Approvals
To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.
3. ENFORCEMENT ACTION
(a) Forfar, Montrose, Carnoustie, Arbroath and Monifieth
There was submitted Report No 1100/97 by the Director of Planning, Transport and Economic Development detailing the circumstances surrounding a recommendation to take enforcement action in relation to the erection of nine illuminated projecting signs as detailed in the report.
The Committee agreed that enforcement action be taken.
(b) Slade Road, Kirriemuir
There was submitted Report No 1099/97 by the Director of Planning, Transport and Economic Development detailing the circumstances surrounding a recommendation to take enforcement action in relation to the storage of a quantity of stone on an area of ground adjacent to Slade Road, Kirriemuir.
The Committee agreed that enforcement action be taken.
(c) No. 3 Cottage Whitehill Faulds, Auchterhouse
There was submitted Report No 1113/97 by the Director of Planning, Transport and Economic Development detailing the circumstances relative to the erection of a building at No. 3 Cottage, Whitehill Faulds, Auchterhouse.
The Committee agreed that enforcement action be taken.
4. DEPARTMENTAL BUSINESS/SERVICE PLAN 1997/98
There was submitted Report No 1038/97 by the Director of Planning, Transport and Economic Development.
The Committee, for its interest, approved the terms of the Report.
5. PLANNING APPLICATION NO 01/97/1509 - CONVERSION OF STEADING INTO THREE DWELLINGHOUSES AT WEST MAIN OF BALLINDARG, PADANARAM, FOR MR AND MRS G WHYTE
With reference to Article 2(iii) of the minute of meeting of this Committee of 9 September 1997, there was submitted Report No 1135/97 by the Director of Planning, Transport and Economic Development indicating that the above application for a development within 80 metres of a Shell and BP pipeline had been granted in the knowledge that the Health and Safety Executive had indicated that it had no objection to the proposal.
It was reported that it had now come to light that the Health and Safety Executive had intended to advise against the grant of planning permission, but due to an administrative error this had not been communicated to the Council. The Health and Safety Executive had apologised for the error and had indicated that they would not ask for the permission to be revoked.
The Committee noted the contents of the report and agreed that the applicants be advised, in writing, of the situation and that a copy of the Report be forwarded to the Secretary of State for information.
