ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 12 November 1998 at 6.00 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.
Apology: An apology for absence was intimated on behalf of Councillor DAVID SELFRIDGE.

1. MINUTES OF PREVIOUS MEETINGS
The minutes of meetings of this Committee held on 3 September and 22 October 1998 were approved as correct records and signed by the Convener.
2. BUILDING WARRANTS
The Committee noted that, in the period 12 October to 30 October 1998, a total of 14 Amendments to Warrants and 94 Building Warrants had been approved with the estimated total value of the work amounting to £2,887,096.
3. PLANNING APPLICATIONS
There was submitted Report No 1163/98 by the Director of Planning and Transport on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.
(ii) Refusals
To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the application detailed in the Appendix to this minute.
(iii) Approvals
To grant consent, subject to the conditions recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.
(iv) Deferred Application
After slides had been shown and objectors and the applicant had been heard, the Committee agreed to defer consideration of Application No 01/97/1755 by Bett Homes Ltd for the erection of 70 houses at land east of Liff Manse, Liff.
(v) Debated Application
The Committee considered Application No 01/98/0667 by A & J Stephen Ltd for the erection of 90 houses at Dronley Road, Birkhill as detailed in Report No 1163/98 (List C) by the Director of Planning and Transport, who recommended conditional approval.
After slides were shown, two objectors addressed the Committee.
COUNCILLOR RITCHIE, SECONDED BY COUNCILLOR MOWATT MOVED THAT THE APPLICATION BE CONDITIONALLY APPROVED AS DETAILED IN REPORT NO 1163/98 BY THE DIRECTOR OF PLANNING AND TRANSPORT, SUBJECT TO THE AMENDMENT OF CONDITION 15 TO READ AS FOLLOWS:-
"That prior to the occupation of any of the houses, a new additional access/egress for the development from Dronley Road, comprising a mini roundabout located between Blacklaw Drive and Hillpark Drive or any other suitable arrangement, be formed to the satisfaction of the Director of Planning and Transport and the Director of Roads."
Councillor Ellis, seconded by Councillor Young, moved that the application be deferred to the next meeting, to allow officials to investigate further the proposed road structure.
On a vote being taken, the members voted:-
For the motion:-
Councillors Mrs Ritchie, Mowatt, Doig, King, Mrs Lamont, Middleton, Shand and West (8)
For the amendment:-
Councillors Ellis, McGlynn, Milne and Young (4).
The motion was declared carried, resulting in the application being conditionally approved.
4. PLANNING APPEAL DECISIONS
(a) North Cotton, South Kingennie
There was submitted Report No 1164/98 by the Director of Planning and Transport on the findings of the Reporter appointed by the Secretary of State to determine the Appeal against the refusal of Angus Council to grant consent for the erection of a house at North Cotton, South Kingennie.
The Committee noted that the Secretary of State had dismissed the Appeal.
(b) Denfield Farm, by Arbroath
There was submitted Report No 1165/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the Appeal against the refusal of Angus Council to grant consent for the use of garden ground for vehicle sales at Denfield Farm, by Arbroath.
The Committee noted that the Secretary of State had dismissed the Appeal.
(c) Old Dronley Road, Backmuir of Liff
There was submitted Report No 1166/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the Appeal against the refusal of Angus Council to grant consent for the erection of two houses at Old Dronley Road, Backmuir of Liff.
The Committee noted that the Secretary of State had dismissed the Appeal.
5. ENFORCEMENT ACTION
(a) Ground Floor Flat - 27 High Street, Arbroath
There was submitted Report No 1168/98 by the Director of Planning and Transport detailing the reasons for a recommendation to take enforcement action in respect of the unauthorised building up of a doorway providing a street access to the ground floor flatted property at 27 High Street, Arbroath.
The Committee agreed that enforcement action be taken if an acceptable resolution of the problem identified in the Report could not be secured in the near future.
(b) 9 Leysmill, by Arbroath
With reference to Article 2(iii) of the minute of meeting of this Committee held on 19 March 1998, when it was agreed that planning permission be granted for proposed earthworks to form a terraced garden at 9 Leysmill, by Arbroath and to Article of the minute of meeting of this Committee of 13 August 1998, when it was agreed to grant further permission for a proposed rear extension to the premises, there was submitted Report No 1169/98 by the Director of Planning and Transport on the progress of the application.
The Report advised that, following the meeting on 13 August 1998, Dr Motwani had been advised that the Committee was dissatisfied with the progress made to date and required the ground levels to be reduced in line with the detailing shown on the approved plans within three months, failing which consideration would be given to taking enforcement action.
Since that time, little progress had been made and approaches had been made to Dr Motwani and his agent in this regard. It had come to light that Dr Motwani had been hospitalised as the result of an assault and that his condition continued to cause concern.
In the circumstances, the Committee agreed:-
(i) that enforcement action be deferred pending the recuperation of the applicant, Dr Motwani, and
(ii) that officials monitor the situation and should insufficient progress be made over the next three months, a further Report be presented to the Committee.
