ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 19 March 1998 at 6.00 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, ALEX SHAND and THOMAS I N YOUNG.
Apologies: Apologies for absence were intimated on behalf of Councillors DAVID SELFRIDGE and SANDY WEST.
Councillor Mrs RITCHIE, Convener, in the Chair.
1. BUILDING WARRANTS
The Committee noted that in the period 16 February 1998 to 6 March 1998 a total of 93 Building Warrants had been approved and 10 amendment to Warrants with the estimated total cost of the work amounting to £6,480,450.
2. PLANNING APPLICATIONS
There was submitted Report No 323/98 by the Director of Planning, Transport and Economic Development
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.
(ii) Refusals
To refuse consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development in respect of the applications detailed in List B of the Report and appended to this minute.
(iii) Recommended Approvals
To grant consent, for the reasons recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.
(iv) Withdrawn Applications
To note that Application No 01/98/0050 (7 Westhaven Park, Carnoustie) and Application No 01/98/0092 (Berryfauld, Arbroath) had been withdrawn.
(v) Debated Application
The Committee considered Application No 01/97/1719 by Piperdam Golf and Country Club Limited for outline consent for additional residential and chalet development and relocation of leisure uses at Piperdam, by Muirhead.
COUNCILLOR MRS RITCHIE, SECONDED BY COUNCILLOR YOUNG, MOVED THAT THE APPLICATION BE REFUSED ON THE GROUNDS THAT THE PROPOSAL WOULD NOT CONFORM TO TAYSIDE STRUCTURE PLAN HOUSING POLICY 15 AND WAS CONTRARY TO THE ADOPTED DUNDEE LOCAL PLAN.
Councillor Ellis, seconded by Councillor Milne, moved, as an amendment, that the application be conditionally approved as recommended in Report No 328/98 (List C).
On a vote being taken, the members voted:-
For the motion:
Councillors Mrs Ritchie, Doig, Mrs Lamont, Middleton and Young (5).
For the amendment:
Councillors Ellis, King, McGlynn, Milne and Shand (5).
Councillor Mowatt - no vote.
There being an equality of votes, the Convener exercised her casting vote in favour of the motion, resulting in the application being refused.
3. REASONS FOR REFUSAL
With reference to Article 4(iii) of the minute of meeting of this Committee of 26 February 1998, when it had been agreed to refuse planning applications nos. 01/97/2124 and 01/98/0002, the Committee endorsed the formal reasons for refusal as detailed below.
Planning Application No. 01/97/2124 - Westfield, Kirriemuir
1. That the proposed development is not in conformity with Housing Policy 4 of the Tayside Structure Plan 1993 in that there is no reason to grant consent for housing development on this site at this point in time.
2. That the proposed site is not included for housing purposes in the consultative draft of the Angus Local Plan and is premature pending the approval of the plan by the Council.
Planning Application No. 01/98/0002 - 46 Grange Road, Monifieth
1. That the mass and scale of the extension would over-shadow and dominate the adjoining properties to an unacceptable degree.
2. That the proposal would constitute a visually intrusive element in the street scene and detract from the architectural quality of the building.
4. PLANNING APPEAL DECISION - 22 AIRLIE STREET, BRECHIN
There was submitted Report No 331/98 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of a dwellinghouse at 22 Airlie Street, Brechin.
The Committee noted that the Secretary of State had dismissed the appeal.
