ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 14 January 1999 at 6.00 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

1. MINUTES OF PREVIOUS MEETINGS
The minutes of meetings of this Committee held on 12 November and 3 December 1998 were approved as correct records and signed by the Convener.
2. PLANNING APPLICATIONS
There was submitted Report No 40/99 by the Director of Planning and Transport on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.
(ii) Refusals
To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.
(iii) Withdrawn Application
To note that Application No 98/01245/FUL by Mrs Banks for the erection of a dwellinghouse at Low Road, Westmuir had been withdrawn at the request of the applicant.
(iv) Approvals
To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or, where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.
(v) Debated Application
The Committee considered Application No 98/01309/FUL by Bett Homes Limited for the erection of 78 houses at land east of Liff Manse, Liff as detailed in Report No 40/99 by the Director of Planning and Transport who recommended conditional approval.
The Committee was reminded that, on 12 November 1998, consideration of an application from Bett Homes Limited for the erection of 70 houses on this site had been deferred in order to allow further discussion of the implications of the proposals for Liff Primary School. The Company had now withdrawn that application and submitted revised proposals.
The Community Council had objected to the application and Mr Nicoll addressed the Committee.
Councillor Ritchie, seconded by Councillor Mowatt, moved that the application be conditionally approved, subject to the 23 conditions recommended by the Director of Planning and Transport and an additional condition to the effect that 10 house plots be reserved for low cost housing, for a five year period, to allow funds to be sought from appropriate services within that time, and thus achieve a better social mix within the development.
COUNCILLOR ELLIS, SECONDED BY COUNCILLOR MILNE, MOVED THAT THE APPLICATION BE REFUSED ON THE FOLLOWING GROUNDS.
(I) THAT THE PROPOSED DEVELOPMENT WAS CONTRARY TO THE ADOPTED RURAL AREAS LOCAL PLAN WHICH DID NOT IDENTIFY THE SITE FOR HOUSING.
(II) THAT THE PROPOSED DEVELOPMENT WAS CONTRARY TO SCOTTISH OFFICE REPORTER'S RECOMMENDATIONS REGARDING HS51 OF THE FINALISED DUNDEE DISTRICT LOCAL PLAN IN THAT A MAXIMUM OF 70 HOUSES INCLUDING 10-15 SOCIAL RENTED UNITS WAS PROPOSED.
(III) THAT THE PROPOSED DEVELOPMENT WAS CONTRARY TO PROPOSAL LI/H3 OF THE ANGUS LOCAL PLAN CONSULTATIVE DRAFT WHICH PROPOSED A MAXIMUM OF 70 HOUSES INCLUDING 10-15 SOCIAL RENTED UNITS.
(IV) THAT THE DEVELOPMENT AS PROPOSED CONSTITUTED AN OVER-INTENSIFICATION OF RESIDENTIAL USE IN COMPARISON TO THE CHARACTER OF THE VILLAGE, THE CAPACITY OF THE SITE AND THE TERMS OF THE LOCAL PLAN.
On the vote being taken the members voted:-
For the motion:-
Councillors Mrs Ritchie, Mowatt, Middleton and West (4);
For the amendment:-
Councillors Doig, Ellis, King, Lamont, McGlynn, Milne, Selfridge, Shand and Young (9).
The amendment was declared carried resulting in the application being refused.
(vi) Deferred Application
To defer consideration of Application No 98/01212/FUL by Keith Watson for the erection of four houses at Wellington Park, Montrose, slides having been shown and an objector heard, to enable the appropriate officers to check the measurements of the application site and an accurate plan to be submitted.
3. PLANNING APPEALS
(a) Westfield, Lindsay Street, Kirriemuir
There was submitted Report No 4/99 by the Director of Planning and Transport on the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the erection of 12 houses at Westfield, Lindsay Street, Kirriemuir.
The Committee noted that the Secretary of State had dismissed the appeal.
(b) Hilton of Guthrie, by Arbroath
There was submitted Report No 5/99 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for a quarry at Hilton of Guthrie.
The Committee noted that the Secretary of State had upheld the appeal.
4. CUSTOMER ADVICE NOTES
There was submitted Report No 35/99 by the Director of Planning and Transport advising that his Department was committed to Customer Care, and as part of that objective, he proposed to produce Customer Advice Notes on how to apply for planning permission and how to object to a planning application.
The Committee welcomed the proposed advice notes and congratulated the Director on producing helpful and detailed guidance for the public who came into contact with his Department.
5. CONSERVATION GRANT FOR STONEWORK REPAIRS AT ARBROATH WEST KIRK
There was submitted Report No 37/99 by the Director of Planning and Transport which outlined a request for a Conservation Grant from the Congregation of Arbroath West Kirk.
The Committee agreed that a one-off Conservation Grant of £3,000 for stonework repairs be granted, which was based upon 50% of the eligible costs.
The Convener ruled in terms of paragraph 11(vi) that the following matter be considered as a matter of urgency in order to allow for the matter to proceed as soon as possible.
6. ST JAMES CHURCH, FORFAR
With reference to Article 6 of the minute of meeting of this Committee held on 22 October 1998, a representative of the Director of Law and Administration advised that numerous approaches had been made to the Royal Bank of Scotland plc which had been identified as heritable creditor having a security over the property. However, they had indicated that they had no proposals for the building at this time.
After discussion, the Committee agreed that a full report on this matter be submitted to its next meeting.
