ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 25 February 1999 at 6.00 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, WILLIAM MIDDLETON, BRIAN MILNE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.
Also Present: Councillor BILL CROWE.
Apology: An apology for absence was intimated on behalf of Councillors STEWART MCGLYNN and DAVID SELFRIDGE
Councillor Mrs RITCHIE, Convener, in the Chair.
1. MINUTES OF PREVIOUS MEETING
The minutes of meetings of this Committee held on 10 December 1998, 14 January and 4 February 1999 were submitted, approved as a correct record and signed by the Convener.
2. BUILDING WARRANTS
The Committee noted that in the period 25 January to 12 February 1999 a total of 15 Amendments to Warrants and 60 Building Warrants had been approved with an estimated cost of £734,695.
3. PLANNING APPLICATIONS
There was submitted Report No 193/99 by the Director of Planning and Transport on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.
(ii) Refusals
To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.
(iii) Approvals
To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.
4. PLANNING APPEAL DECISIONS
(a) Rosemill Farm, by Dundee
There was submitted Report No 194/99 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for infilling at Rosemill Farm, by Dundee.
The Committee noted that the Secretary of State had dismissed the appeal.
(b) Cunmont Quarry, Newbigging
There was submitted Report No 195/99 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent to infill Cunmont Quarry, Newbigging.
The Committee noted that the Secretary of State had dismissed the appeal.
5. HATTON WASTE WATER TREATMENT WORKS
There was submitted Report No 217/99 by the Director of Planning and Transport advising that a planning application had been received for a major waste water treatment works at Hatton, by Carnoustie. The Report advised that, in view of the very technical nature of the application, specialist consultants would be beneficial to aid the determination of the application.
The Committee agreed that up to £5,000 be authorised to engage consultants to assist in the examination of the tidal modelling data and the impact of the effluent discharge into the North Sea and Tay Estuary as set out in the Report.
6. CONSERVATION CHARTER
There was submitted Report No 196/99 to which was appended, for the information of the Committee, a copy of the Planning and Transport Departments Customer Care Charter for Conservation.
The Committee agreed that the Customer Care Charter for Conservation be adopted and made available to the general public and other Council Departments.
The Convener ruled in terms of Standing Order 11(2) that the following item be considered as a matter of urgency in view of the need to take action quickly as a result of failed negotiations
7. ST JAMES CHURCH, FORFAR
Reference was made to Article 7 of the minute of this meeting of this Committee held on 4 February 1999 when it had been agreed that the Director of Law and Administration, in consultation with the Director of Planning and Transport, pursue negotiations with The Royal Bank of Scotland Plc and the prospective developer of the above church with a view to securing redevelopment of the building and bringing it back into beneficial use. It was reported that negotiations with the Bank had failed to bring about a mutually satisfactory agreement. Accordingly the Council now had no choice but to board up the building at an estimated cost of £9,000.
After hearing various members on the matter, the Committee agreed that the Council make the building wind and watertight as detailed in Report Nos 1113/98 and 140/99
