ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 27 May 1999 at 6.00 pm.
Present: Councillors STEWART McGLYNN, FRANK ELLIS, JOHN HENDERSON, ALEX KING, THE HON R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, MRS KITTY RITCHIE, BILL ROBERTON, DAVID SELFRIDGE and RICHARD SPIERS.
Apology: An apology for absence were intimated on behalf of Councillor SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS
The minutes of meetings of this Committee held on 8 and 22 April 1999 were submitted, approved as a correct record and signed by the Convener.
2. BUILDING WARRANTS
The Committee noted that in the period 12 April to 14 May 1999 a total of 60 Building Warrants had been approved with an estimated cost of £6,768,730.
3. PLANNING APPLICATIONS
There was submitted Report No 496/99 by the Director of Planning and Transport on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.
(ii) Refusals
To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.
(iii) Approvals
To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.
(iv) Withdrawn Applications
To note that the six applications detailed in the Appendix to this minute had been withdrawn.
4. PLANNING APPEAL DECISIONS
(a) 24 Warslap Avenue, Arbroath
There was submitted Report No 510/99 by the Director of Planning and Transport on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of a dwellinghouse at 24 Warslap Avenue, Arbroath.
The Committee noted that the Secretary of State had dismissed the appeal.
(b) George Hotel, Montrose
There was submitted Report No 511/99 by the Director of Planning and Transport on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of downlighters at the George Hotel, Montrose.
The Committee noted that the Secretary of State had dismissed the appeal.
5. ENFORCEMENT ACTION - R S HILL, DOUGLASTOWN
With reference to article 5(d) of the minute of meeting of this Committee held on 18 March 1999, there was submitted Report No 512/99 by the Director of Planning and Transport which detailed the ongoing circumstances relative to possible enforcement action in respect of a setting down/storage area created by Messrs R S Hill, Joiners and Building Contractors, Douglastown, Forfar. The Report noted that Mr Hill had now submitted a programme of works as required by the Committee. This was designed to transfer the materials and plant stored in the illegal yard at Douglastown to the authorised yard within Scroggerfield Farm.
After discussion, the Committee agreed that the work schedule provided by Mr Hill be accepted and that a further report on the progress be submitted to the Committees meeting on 12 August 1999.
6. ADVICE NOTES ON THE SITING AND LANDSCAPING OF BUILT DEVELOPMENT IN THE COUNTRYSIDE; THE SURVEY OF TREES ON DEVELOPMENT SITES; AND THE SPECIFICATION OF LANDSCAPING PROPOSALS FOR DEVELOPMENT SITES
There was submitted Report No 514/99 by the Director of Planning and Transport which detailed draft copies of the Planning and Transport Departments proposed Advice Notes on The Siting and Landscaping of Built Development in the Countryside; The Survey of Trees on Development Sites; and The Specification of Landscaping Proposals for Development Sites.
The Committee agreed to approve the draft text as the basis for the three proposed Advice Notes on the above matters.
7. SECTION 50 AGREEMENT (NOW SECTION 75) AT PRESSOCK FARM, GUTHRIE, BY FORFAR
With reference to Article No 8 of the minute of meeting of this Committee held on 4 February 1999, there was submitted Report No 515/99 by the Director of Planning and Transport which detailed a further request to vary the terms of the Section 50 Agreement at Pressock Farm, Guthrie.
The Committee agreed that the Section 50 Agreement pertaining to Pressock Farm, on application, be varied to restrict occupancy to anyone employed in agriculture and that the current occupier be informed that he and his immediate family, on a personal basis only, would be allowed to remain in occupation of the farmhouse irrespective of whether or not Mr Arbuckle was employed in agriculture.
