ANGUS COUNCIL
MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 8 April 1999 at 6.00 pm.
Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND, and THOMAS I N YOUNG.

Councillor Mrs RITCHIE, Convener, in the Chair.
1. MINUTES OF PREVIOUS MEETINGS
The minutes of meetings of this Committee held on 25 February and 18 March 1999 were submitted, approved as a correct record and signed by the Convener.
2. BUILDING WARRANTS
The Committee noted that in the period 8 March to 26 March 1999 a total of 7 Amendments to Warrants and 96 Building Warrants had been approved with an estimated cost of £5,334,176.
3. PLANNING APPLICATIONS
There was submitted Report No 394/99 by the Director of Planning and Transport on applications for planning consent.
The Committee agreed as follows:-
(i) Delegated Approvals
To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.
(ii) Refusals
To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.
(iii) Approvals
To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.
(iv) Debated Application
The Committee considered Application No 98/01174/FUL by North of Scotland Water Authority for the construction of a Wastewater Treatment Plant, Landscaping Improvements to A92/Access Road Junction and Access Road at Hatton Farm, Carnoustie as detailed in Report No 394/99 (List C) by the Director of Planning and Transport, who recommended conditional approval.
Slides were shown, following which objectors and the applicants were heard.
Councillor Selfridge, seconded by Councillor Mrs Lamont, moved that the application be refused on the following grounds:
(i) if the application was accepted, over twenty three acres of Grade 1 agricultural land would be lost forever, and that the strip of agricultural land from Panbride to Netherkelly represented 50% of Scotlands Grade 1 land;
(ii) with reference to NPPG13 Coastal Planning there were feasible alternative sites existing in Dundee and the Wastewater Treatment directive could still be met; and
(iii) the impact of heavy traffic, particularly HGV access to A92, compared to the previous application in October 1997.
COUNCILLOR MOWATT SECONDED BY COUNCILLOR MILNE MOVED THAT THE APPLICATION BE APPROVED SUBJECT TO THE CONDITIONS DETAILED IN THE REPORT.
On a vote being taken, the members voted:-

For the amendment:-
Councillors Mowatt, Doig, Ellis, McGlynn, Middleton, Milne, Shand and Young (8).
The amendment was declared carried and became the substantive motion.
Councillor Selfridge, seconded by Councillor Mrs Lamont, moved as a further amendment that the application be deferred until such time as meaningful discussion had taken place between the applicant and the tenant farmers, Residents Association and Community Council in relation to planning gain as detailed in paragraph 5.30 of Report No 394/99 by the Director of Planning and Transport.

The motion was declared carried, resulting in the application being conditionally approved subject to the conditions detailed in the Report.
In response to a question, the Convener, after consulting officers, indicated that she considered that Note(2) to the Order of Reference of the Development Control Committee applied, and that it was therefore open to two members to refer the matter to the Council for consideration.
5. REVIEW OF MONTROSE CONSERVATION AREA AND PROPOSED ARTICLE 4 DIRECTION
There was submitted Report 395/99 by the Director of Planning and Transport which explained the public consultation proposals for the review of the Montrose Conservation Area and implementation of an Article 4 Direction.
The Report noted that the proposal to review all the Angus conservation areas and to consider implementing Article 4 Directions had already been raised in the Consultative Draft Angus Local Plan and had now been incorporated into the Finalised Draft. The Report therefore proposed to take the ideas a step further and to refer back to the relevant Committees at the appropriate stage.
The Committee agreed to approve the proposed revisions to the Montrose Conservation Area boundary and the classes identified in the Report as applicable for an Article 4 Direction for the purposes of public consultation.
