Angus Development Plan Scheme 2009-2010

At their meeting of 3 March 2009 the Infrastructure Services Committee agreed Report 198/09 (120 KB PDF) which set out the first Development Plan Scheme for Angus.

As required by Section 20B of the Planning etc (Scotland) Act 2006, two copies of the Development Plan Scheme have been submitted to Scottish Ministers by 31 March 2009. A reference copy of the Scheme is also available at all Angus Public Libraries and ACCESS Offices.

Angus Council Adopt Angus Local Plan Review

Angus Council at their meeting of 19 February 2009 agreed by resolution to Adopt the Angus Local Plan Review with an operational date of 20 February 2009. The adopted Angus Local Plan Review now replaces the previous Angus Local Plan (adopted November 2000) and together with the approved Dundee and Angus Structure Plan (approved by Scottish Ministers in October 2002), comprise the Statutory Development Plan.

In accordance with the Town and Country Planning (Structure and Local Plans) (Scotland) Regulations 1983, Angus Council published a Notice of Adoption of the Angus Local Plan Review on 6 March 2009. As required by the Regulations, 2 certified copies of the adopted Angus will be sent to the Scottish Government.

Any person aggrieved by the Local Plan who desires to question its validity on the grounds that it is not within the powers conferred under Part II of the Town and Country Planning (Scotland) Act 1997, or that any requirement of the said Part II or of any Regulation made thereunder has not been complied with in relation to the adoption of the Plan, may within six weeks from 6 March 2009, make an application to the Court of Session under Section 238 of the Town and Country Planning (Scotland) Act 1997.

The process of adopting the Angus Local Plan Review will only be fully completed following conclusion of the period for legal challenge. Arrangements are currently being made to print a consolidated version of the adopted Local Plan Review.

A full copy of the adopted Angus Local Plan Review will be available free of charge on CD from 6 March 2009. When printed, hard copies of the consolidated adopted Local Plan will cost £30.00 each including post and packaging.

Existing Development Plan Framework

The first Angus Local Plan was adopted by Angus Council on 23 November 2000. The Local Plan set out land use policies and proposals for core topics, towns, villages and countryside and established the framework and guidance for dealing with development proposals for the period to 2006. This together with the Dundee & Angus structure Plan (approved by Scottish Ministers in October 2002) provides the current Development Plan framework in Angus.

Angus Local Plan Review

Background

Although the Development Plan was current, Angus Council undertook a review and roll forward of the first adopted Angus Local Plan and published the Finalised Angus Local Plan Review in February 2005 (23 MB PDF) (NOTE: This is a very large file. It will take a long time to download on a slow connection. It is advised that you use the menu down the left hand side of the page to download the particular section of the document which is of interest.) This document establishes policies and proposals that will guide future development, land use and investment in Angus in the period to 2011 in accordance with the Dundee and Angus Structure Plan. When adopted, the Angus Local Plan Review will replace the previously adopted Angus Local Plan (2000).

Angus Council also published a Statement of Publicity & Consultation (2 Volumes): This sets out the steps the Council took to ensure adequate publicity and consultation during the Local Plan review process and how responses and representations received influenced the content of the Finalised Local Plan Review.

In addition Angus Council commissioned a Sustainability Appraisal of the Consultative Draft Local Plan and the consultants report was published as a separate background paper(720 KB PDF) .

Response to Objections and Pre-inquiry Modifications

The Council's response to several areas of objections raised to the Finalised Local Plan Review was agreed by a special meeting of the Infrastructure Services Committee on 9 September 2005 (Report 1081/05 (329 KB PDF). These are set out in a number of appendices. Objections relating to Auchmithie village were considered as part of a report to the Infrastructure Services Committee on 13 October and published as second round modifications. (Report 1179/05 (196 KB PDF) A Special meeting of Angus Council held on 18 October 2005 dealt specifically with objections relating to Local Plan policy and Arbroath Retail Development (Report 1080/05 (340 KB PDF). Changes were published as part of second round modifications.

Arising from this a first round (2.5 MB PDF) and second round (120 KB PDF) of pre-inquiry modifications were published on 23 September 2005 and 4 November 2005 respectively.

The Council's response to objections relating to countryside housing policy, wind energy policy, Carnoustie employment land, Letham Grange development strategy and Woodville was agreed by the Infrastructure Services Committee on 24 November 2005 (Report No 1415/05 (92 KB PDF). A subsequent third round (430 KB PDF) of pre-inquiry modifications was published on 2 December 2005.

Public Local Inquiry (2006)

Angus Council appointed Richard Dent and Richard Bowden, Scottish Government Reporters to conduct a Local Plan Public Inquiry (PLI) into unresolved objections to the Finalised Angus Local Plan Review. The PLI took place over several weeks between the 23 January and 31 March 2006. A continuation day for Arbroath Retail objections was held on 25 April 2006.

The Reporters' submitted their Report of the Public Local Inquiry (PLI) into the Finalised Angus Local Plan Review to Angus Council in late August. The Council made the PLI Report available to the general public, for information only, in advance of the Council considering and responding to each of the Reporters recommendations. The Council also notified all previous objectors that the Local Plan Review Public Local Inquiry Report has now been received.

Post Inquiry Modifications

The Council published Post Inquiry Modifications (4 MB PDF) on 14 February 2007. The period for objections closed on Tuesday 27 March 2007.

A Special Meeting of Angus Council held on 22 August 2007, considered Report 728/07(219 KB PDF) which summarised and responded to the objections received and accompanying Schedule 1 (461 KB PDF) which provided a more detailed summary, assessment and recommendation for individual objections to the Post Inquiry Modifications.

Pre-Second Inquiry Modifications

Following the Special Council Meeting, Angus Council published their Statement of Response (948 KB PDF) and Proposed Pre-Second Inquiry Modifications (198 KB PDF) to the Finalised Local Plan.

The modifications were published on 12 September 2007 with a fixed 6 week period for objection extending until 23 October 2007.

A number of representations were received during the period for objection relating to housing sites in Forfar and Kirriemuir.

Strategic Environmental Assessment (SEA)

The Scottish Government granted Angus Council an exemption from the need to carry out a Strategic Environmental Assessment (SEA) of the Finalised Angus Local Plan Review (2005) on 28 March 2006. This follows on from a submission made to the Executive by the Council on 16 February 2006.
