Who does the council ask about my application?

Tayside Police are asked to give the council any information about you which will help us decide if you are a "fit and proper person" to hold a licence.

In certain circumstances other departments of the council and external agencies are consulted if applicable, however the main consultees are as follows:-

Environmental and Consumer Protection - This department, which encompasses both environmental health and trading standards, is consulted on all applications relating to:

Planning and Transport - This department is consulted in respect of applications relating to:

Roads - This department is consulted in relation to street trading licence applications where a fixed pitch is sought, approval of civil marriage venues and where applicable, temporary public entertainment applications.

Leisure Services - This department is consulted in respect of applications for street traders or public entertainment licences if Council parks or other ground to be used would require a ground let to be entered into between the licence holder and Leisure Services.

Finance - All applications.

Housing - All applications relating to houses in multiple occupation are sent to the Housing Department.

Building Control - This section is consulted in respect of applications for houses in multiple occupation, approval of civil marriage and civil partnership registration venues.

Fire - All applications relating to premises and outdoor events are sent to Tayside Fire Brigade.

Health and Safety Executive - All applications relating to fun fairs are submitted to HSE for information.

Senior Registrar - All applications for period or temporary approval of places as venues for civil marriages and civil partnership registration are sent to the council's Senior Registrar of Births, Deaths and Marriages for advice on their suitability. Places which would compromise the solemnity and dignity of civil marriage or with a recent or continuing religious connection cannot be approved.

Charitable Collection Period varies from daily to weekly which may cover an area or various areas within Angus.
Public Processions Processions are usually permitted for one day only.

Do I have to pass any tests?

No.

Who decides whether or not I can have a licence?

If there are no objections to your application, then it can be dealt with and granted under delegated authority by the Head of Law and Administration. However, if there are objections or observations, from either Tayside Police or another party, then your application is submitted to the council's Civic Licensing Committee for consideration by elected Councillors.

How long does it take to get a licence?

For licences under the Civic Government (Scotland) Act 1982, there is a minimum statutory period of 21 days within which objections or observations can be made. From the date of your application, the council has a maximum period of six months to either grant or refuse your application.

For all other licences, permits and certificates, a similar timescale applies.

What conditions are attached to a licence?

There are various conditions attached depending on the type of licence you apply for. These will be shown on your licence. Copies of the standard conditions relating to each type of licence can be obtained at any time from the Licensing Section. Your own licence may be granted subject to additional specific conditions dependant upon circumstances.

What area does the licence cover?

Dependant on whether the licence relates to a business carried on in premises or whether the licence is granted to an individual, it would be granted for specific premises or the whole of Angus Council area.

Do I need a medical?

No.
