Special Arrangements Committee and Special Education Committee

At the special Council meeting on Friday 3 April 2020 the Council agreed to set up two new (special) committees.

Remit of the Special Arrangements Committee

To decide any matter which would normally be decided by

  1. the Council as provided for in the Order of Reference of Committees subject to the following exclusions:

    1. Changing the name of the Council in terms of section 23 of the 1973 Act.   
    2. The appointment of the Leader and Depute Leader of the Council and early removal from office.  
    3. The appointment of Committees in terms of section 57 of the 1973 Act.
    4. The promotion and opposition of private legislation in terms of section 82 of the 1973 Act.
    5. Setting Council Tax in terms of section 56(6) of the 1973 Act.  
    6. Receiving the uncertified abstract of the Council’s annual accounts.  
    7. The consideration of reports by the Head of Paid Service under section 4 of the 1989 Act.  
    8. The consideration of reports by the Monitoring Officer under section 5 of the 1989 Act.  
    9. To determine whether or not to divide the Council’s area into Licensing Divisions and whether or not  to revoke a previous determination, in terms of Section 5 of the Licensing (Scotland) Act 2005 and to elect Members to Boards in terms of Schedule 1 to the Licensing (Scotland) Act 2005. 
    10. Preparation and review of the Scheme for Community Councils (Special Meeting).  
    11. To consider any report from the Standards Commission for Scotland in respect of any breach of the National Code of Conduct by an Elected Member, and 
    12. any other matter which is by statute reserved to Council for consideration.
  2. the Children and Learning Committee, as detailed in the Order of Reference of Committees, excluding the functions of the Council as education authority within the terms of the relevant legislation,

  3. the Communities Committee, as detailed in the Order of Reference of Committees, and 

  4. the Policy and Resources Committee as detailed in the Order of Reference of Committees

Remit of the Special Education Committee

To decide any matter which would normally be decided by the Children and Learning Committee, as detailed in the Order of Reference of Committees which falls within the functions of the Council as education authority within the terms of the relevant legislation. 

Angus Council agreed at a meeting on 12 August 2020:

(i) to note the decision of the Special Arrangements Committee of 24 June 2020, as outlined in Section 3 of the Report, and consequently:-

(ii) to agree to dis-establish the Special Arrangements Committee;

(iii) to agree to dis-establish the Special Education Committee;

(iv) to agree to remove the suspension of the delegations to the Policy and Resources Committee, the Children and Learning Committee and the Communities Committee;

(v) to agree that the Policy and Resources Committee, the Communities Committee and the Children and Learning Committee will each re-assume as the parent committee of their respective sub-committees as was the position before the establishment of the Special Arrangements Committee and the Special Education Committee; 

(vi) to note that meetings of all Committees and Sub-Committees will continue to be undertaken on a remote basis as permitted under Section 43 of the Local Government in Scotland Act 2003, subject to the appropriate direction of the Chair of the meeting; 

(vii) to note that meetings of Committees will take place in accordance with the previously agreed timetable of meetings;

(viii) to agree that meetings of Committees or Sub-Committees will now be able to consider matters delegated to that Committee or Sub Committee which need not be time critical or necessary; 

(ix) to agree that the Standing Orders which were in place prior to 3 April 2020, as amended to include provision for meetings to take place on a remote basis (as detailed in paragraph 4 of the Report) as permitted under Section 43 of the Local Government in Scotland Act 2003, will now apply to all Council, Committee and Sub Committee meetings which take place;

(x) to agree that the extension to officer delegation, including any interim emergency powers (as detailed in Appendix 1) will cease with immediate effect; and

(xi) to agree that the original version of the Order of Reference of Committees and the Scheme of Delegation to Officers and not the interim arrangements version, will now apply and be effective from 13 August 2020
