Skills and Employability Privacy Notice

What we need and why

The council is the ‘Data Controller’ of the personal data you provide to us. We only collect personal data that is required to provide you with the appropriate Skills and Employability support. Your personal information is held on servers within the UK and processed by our staff in the UK.

Information necessary for participation in our skills and employability services may include all or some of the following:

  • Name and address
  • Contact number
  • NI number
  • Employment history and current status
  • Date of birth
  • Equalities*
  • Gender
  • Care experienced
  • Disability and health*
  • Caring responsibilities

The data will be used to support your participation in the employability programme and as such will be used for the following purposes:

  • to monitor the success and performance of services offered and to undertake evaluations
  • to confirm your positive destination, whether this be FE/HE or Employment, we will contact them to confirm
  • to contact you for feedback regarding the quality of services provided to you
  • to monitor compliance with equal opportunities legislation
  • to ensure compliance with financial regulations and contractual obligations.

* Some of the information that may be collected is classified as special category data. This data is necessary to ensure a complete understanding of the barriers to employment that may be present and to help make sure the appropriate level of employability support is provided.

Who your information may be shared with

To enable delivery of the support, your information will be shared with the following organisations:

  • Local Employability Partnership (LEP) partners for Get Ready for Work (GRfW), Long Term Unemployed (LTU) and Employer Recruitment Incentive (ERI)
  • Skills Development Scotland in accordance with contractual obligations for Modern Apprenticeship (MA)
  • Funders, administrators and auditors of the project, e.g. Audit Scotland.

Your information may be shared with other organisations where there is a legal obligation to do so. Other organisations may include Government Agencies, such as the Department of Work & Pensions. The purpose for sharing personal information would include protecting taxpayer money for example sharing of personal data for the purpose of data matching used for the prevention and detection of fraud. Your data will be exchanged electronically between parties using secure systems/encryption.

How long we keep your information

Your personal information and data are kept for 7 years from your exit from our service. At this point your data will be deleted from our system. This data is kept for statistical information, audit and financial regulations to comply with service delivery and public task.

What are your rights

If at any point you believe the information, we process on you is incorrect you may request to see this information and have it corrected/deleted. Further information is available on the council’s website (Full Privacy Statement).

If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer who will investigate the matter. If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law, you can complain to the Information Commissioner’s Office (ICO).
