Section 85 - Skip Permit

Applications for a skip permit should be made on behalf of the customer by the hire company.

The applicant is liable for any incidents resulting from its use. We have set a minimum indemnity limit of £5m per incident.

Skip hire companies must apply for skip permits on behalf of their customers otherwise, the customer would need their own Public Liability Insurance. 

If a Section 58 Scaffolding permit has been granted for the same portion of the road, a separate skip permit is not needed.

Timescales

Applications should be submitted:

  • at least 10 working days before the start date for non-traffic sensitive routes
  • at least 20 working days before the start date for traffic sensitive routes.
Fees

Skip permit charges fall into separate categories - traffic sensitive & non traffic sensitive. The charges are:

  • £66.85 per month non-traffic sensitive
  • £129.00 per month traffic sensitive

Conditions of permissions

Indemnity

The holder of this permission shall indemnify the Council as Roads Authority for and against all actions, claims, demands, losses, and expenses of whatsoever kind or nature which may be brought or made against them or incurred by them in respect of the negligence omission or default of the holder of this permission or those from whom the holder of this permission is responsible arising in respect of any operation authorised by this permission unless due to the negligence or other breach of legal duty on the party of the Council or of any person for whom the Council are responsible. The applicant is/are responsible for any third party claims resulting from or any damage caused by the skip. Public Liability Insurance cover with a minimum indemnity limit of £5 million for each claim arising must be provided. Proof of insurance is required and a copy of the policy shall be attached to this application.

Road Safety

Each skip or group of skips shall while on the road be marked, guarded, and lit in accordance with the requirements of Chapter 8 of the Traffic Signs Manual (see diagram) and:

  1. The ends of each skip shall be painted yellow and there shall be attached to each end so as to be visible to traffic, strips of material composition, position and dimensions of which comply with the Builders’ Skips (Markings) (Scotland) Regulations 1986 (S.I 1986 No 642(S.61), available form Her Majesty’s Stationery Office). The painting and the strips of material shall at all times be kept clean.
  2. Each skip shall be guarded by at least 3 traffic cones placed on the carriageway in an oblique line on the approach side of the skip. (Where 2 or more skips are deposited in a row, so that the distance between adjacent skips does not exceed 2 metres, the row shall be guarded as if it were one skip).
  3. At night (that is to say, between half-an hour after sunset and half-an-hour before sunrise) a lamp shall be placed against or attached to each corner of the skip or the end corners of the row of skips where two or more skips are deposited in a row and the distance between adjacent skips does not exceed 2 metres, and shall also be placed between each cone and the next. Lamps shall comply with the Traffic Signs Regulations and General Directions 1981.

General

  1. Bulk containers and skips for use on the road for disposal of building materials, rubble, waste, household and other rubbish and earth shall comply with the appropriate Motor Vehicles (Construction and Use) Regulations when carried on a vehicle.
  2. Each skip shall be positioned so that its longer sides are parallel to the edge of the carriageway and as near to the edge of the carriageway as is reasonably practicable and so that it does not impede the surface water drainage of the road nor obstruct access to any manhole of the apparatus of any statutory undertaker of the Council or any fire hydrants.
  3. Where more than one skip is on the road at anyone time, the skips shall be positioned as closely as possible to each other, but not so as to obstruct access to any premises unless the consent of the occupier of those premises has been obtained.
  4. Any skip used by way of this permission and sited on road shall not contain asbestos, noxious, toxic, inflammable, explosive or otherwise dangerous material and advice should be sought from the Environmental & Consumer Protection Division of the Council regarding the correct disposal of any such material.
  5. No skip shall be used in such a way that any of its contents obstruct the road or footway or fall on the road, or that there is an escape of dusty from the contents of the skip when standing on the road.
  6. Each skip shall be removed for emptying as soon as practicable and in any case not later than two working days after it has been filled.
  7. No skip shall remain on the road after the period of permission specified has expired, and the applicant must seek an extension to any permit which has time expired.
  8. All materials placed in each skip shall be properly disposed of and the road, where the skip has been deposited shall be left in a clean and tidy condition on removal of the skip.
  9. The skip shall be clearly and permanently marked with the owner’s name and with his telephone number or address.
  10. The permit shall be shown, on demand, to any police officer or official of the Roads Division.
  11. Any person depositing a skip on a road without permission of the Roads Authority commits offence. It should be noted that the terms ‘road’ encompasses the carriageway, footway and/or verge of any road and any remote public footpaths or cycle track.
  12. Section 85 (1),(2),(5) of the Roads (Scotland) Act 1984 empowers the local Roads Authority to impose conditions to its permission relating in particular to the siting and lighting of the skip, the care and contents of the skip and the removal of the skip at the end of the period of the permission. Section 85 (3) makes it an offence to use a skip in contravention of the Act and specifies a fine not exceeding £400.
  13. Not withstanding the granting of this permission, Section 86 of the Roads (Scotland) Act 1984 empowers a police officer to have removed or repositioned any builder’s skip which is causing or likely to cause a danger or obstruction irrespective of permission being granted under Section 85. Failure to comply with a request to remove or reposition a skip may result in a fine not exceeding £100.

Skip safety measurements
  1. The width of the marking shall not be less than 140 mm nor more than 280mm.
  2. The length of each half of the marking shall not be less than 350mm nor more than 700mm.
  3. The angle of each stripe shall not be less than 40 degrees to the vertical nor more than 50 degrees to the vertical.
  4. Each half of the marking shall have a minimum area of 980sq.cm.
  5. The breadth of each stripe shall not be less than 133mm nor more than 147mm.
