Short-term lets

The Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) Order 2022 came into force on 1 March 2022.


Action by hosts and operators

New hosts and operators must apply for a licence from 1 October 2022.

Existing hosts and operators will have until 1 April 2023 to apply for a licence.


Planning permission/certificate of lawfulness

Your licence application may require you to provide evidence that you either:

  • have planning permission or
  • have a certificate of lawfulness of use confirming you do not need planning permission

Planning permission for change of use from any other use (including for example, use as a dwelling) to use as a short term commercial visitor accommodation may be required in most cases.

You do not normally need planning permission if you live in a house (this does not apply to a flat) in the following circumstances:

  1. where you are only letting one bedroom in your own home and it has fewer than four bedrooms, or
  2. where you are only letting one or two bedrooms in your own home and it has four or more bedrooms.

The following will be taken into consideration when making a decision on planning permission:

  • character of the new use and of the wider area
  • property size
  • reliance on mutual or shared areas such as communal accesses, stairwells, gardens, or parking
  • pattern of activity associated with the use including numbers of occupants, period of use, noise, disturbance and parking demand
  • nature and character of any services provided

Obtaining planning permission or a certificate of lawfulness can take some time. We'd encourage you to apply at least four months in advance of your licence application.
